The Platform functions as an orchestration interface integrated with third-party vendors. Users explicitly acknowledge that their computing parameters and message content are handled by external infrastructures, including distributed Cloud Hosting Nodes, Geolocation Mapping APIs, and Telecommunication Gateways routing OTP alerts.
In compliance with the Digital Personal Data Protection (DPDP) Act, 2023, independent Academies, Gated Community Admins, and Professional Coaches act as the sole Data Fiduciaries regarding localized configurations. The Platform acts solely as a Data Processor supplying the technical software architecture to compute the instructions given by the Data Fiduciaries.
The Platform caters to sports participants, which inherently includes athletes under the age of 18 ("Minors"). Under the DPDP Act, 2023, the processing of a minor's personal data requires verifiable parental consent. By registering an account for a minor athlete, you legally verify that you are the parent or legal guardian of the minor, and you explicitly consent to the collection, mapping, and sharing of the minor's sports telemetry, scores, and location parameters within the platform's ecosystem.
Upon registration, a persistent monitoring relationship is established with the platform owner ("Oracle"). Oracle retains complete, permanent, and unencrypted read access to all system branches, tables, and log nodes cover total athlete counts, staff payroll fields, clinic schedules, coaching logs, structural unit configurations, and fee registers, accessible on demand to maintain system security.
When a Community Admin enrolls an employee, the system indexes their join dates. Upon the execution of a staff termination command, the platform instantly modifies active system roles to block that profile from querying user files or generating court entry tokens.
To regulate physical facility access, the platform processes court-entry OTPs in real-time. Upon a successful OTP match, the system triggers an automated duration timer node. The runtime metrics—including activation timestamps and elapsed playtime data—are tracked continuously to reduce the athlete's balance hours.
In accordance with the Information Technology Rules, 2021, and the DPDP Act, the Platform has established a mechanism to address data privacy grievances. Any user detecting automated scraping, unauthorized tracking, or wishing to invoke data erasure protocols may submit a formal request to our Designated Grievance Officer via the email address listed in the User Agreement's Notice & Takedown section.

This User Agreement is a binding legal contract between the interacting end-user ("User", "Academy", "Community", "Coach", "Athlete") and the Platform. Accessing the platform layout, logging into an account, or confirming facility reservations indicates your complete acceptance of these terms. If you do not agree, your platform license is instantly revoked.
This agreement shall be governed by and construed in accordance with the laws of India.
Exclusive Forum Selection Clause
You irrevocably agree that any legal action, lawsuit, or judicial proceeding arising out of or relating to this Platform must be filed exclusively in the competent civil and criminal courts located in Hyderabad, Telangana, India. You hereby waive any objection to the laying of venue in these courts.Under the Indian Contract Act, 1872, agreements entered into by individuals under the age of 18 are void ab initio. To utilize the Platform on behalf of a minor athlete, a legal guardian must authorize the account. By operating a minor athlete's profile, you (the parent/guardian) enter into this legally binding contract on their behalf. You assume 100% of all legal liability, injury risk, property damage liability, and financial obligations incurred by the minor while using the Platform, utilizing the messaging layers, or attending booked academy slots.
The Platform operates strictly as a Digital Bulletin Board and Classifieds Directory. We do not sell sports slots, we do not employ coaches, and we are not the Merchant of Record for any sporting service. To the fullest extent permitted under the Central Goods and Services Tax (CGST) Act, specifically Section 9(5), the Platform explicitly rejects classification as an "E-Commerce Operator" liable for collecting tax on the gross value of services. Academies, Communities, and Coaches are solely responsible for remitting all applicable local taxes, GST, and income taxes generated from their independent operations discovered via our directory.
The Platform is provided strictly on an "As-Is", "As-Available", and "If-Available" basis. The User explicitly acknowledges that the platform owner does not guarantee unbroken code, continuous uptime, or the ability to rapidly resolve software bugs in the live environment. The Platform Owner reserves the sovereign, unilateral right to indefinitely suspend, abandon, or permanently shut down the platform entirely, at any time, for any reason with zero refund or data recovery obligations.
Under the Consumer Protection (E-Commerce) Rules, 2020, the Platform operates exclusively as an inventory-free intermediary marketplace. We do not own, control, vet, or manage the physical slots, coaching services, or academy courts listed on the interface. The Platform explicitly rejects any "Fallback Liability." If an Academy or Coach cancels a session, goes out of business, or fails to deliver the promised service, your sole legal remedy is against that specific seller. The Platform assumes zero liability for refunds or replacement services.
The Platform accepts zero liability for the interruption of real-world sports activities. If a booked academy slot, coaching clinic, or tournament is canceled due to severe weather (rainouts, floods, heatwaves), structural damage to the venue, government-mandated curfews, or public health lockdowns, the Platform is entirely severed from the conflict. All refund processing, rescheduling, or financial restitution must be negotiated strictly between the Athlete and the Academy/Coach.
The Platform operates as an Intermediary under Section 79 of the IT Act. We do not actively monitor or curate text pushed via direct write pipelines (e.g., Coach evaluations). We will not delete or alter peer-generated content based on informal demands or verbal disputes. To invoke a content takedown, report abuse, or report a DPDP Act privacy violation, you must submit a formal request to our Designated Grievance Officer.

We do not conduct criminal background checks, verify professional certifications, or psychologically evaluate any user on this platform. The inclusion of a Coach or Staff member on our directory does not constitute an employment, agency, or joint-venture relationship. If an athlete suffers physical, emotional, or financial harm from an interaction with a Coach or Staff member during a booked session, the Platform disclaims all vicarious liability for "negligent hiring" or failure to warn.
The system provides community managers with tools to query athlete files by entering structural unit configurations or mobile numbers. The Community Admin assumes the absolute role of Data Fiduciary under the DPDP Act, 2023. If a resident or the Data Protection Board files a grievance, lawsuit, or financial penalty against the Platform for unauthorized tracking executed by community staff, the Community Admin agrees to fully defend, indemnify, and hold the Platform harmless for all regulatory fines, legal costs, and damages.
When an OTP is verified, the system initializes an automated session duration timer to reduce the user's subscription balance. Schedulers and participants explicitly agree that the duration calculation is contingent on manual interface handshakes. The Platform assumes zero financial or legal liability if a software synchronization glitch, network delay, or staff error causes an incorrect hour deduction.
The Platform relies on external cloud hosting arrays, mapping APIs, and telecommunication aggregate gateways to route OTP alerts and verifications. You agree to hold the Platform harmless from any failed token transmissions, dropped database connections, delayed verification texts, configuration errors, or network delivery issues originating with these downstream third-party infrastructure providers.
By registering a portal profile, the User explicitly grants the platform owner ("Oracle") permanent read visibility over all backend database branches at any time. The user fully releases the Platform from any liability regarding trade secret claims, commercial privacy complaints, or business data leakage allegations arising from Oracle's internal review and compliance activities.
The Platform does not process, handle, route, or escrow real-world monetary exchanges between users. All financial transactions—including academy slot fees, coaching salaries, community packages, lane rentals, or balance reminders—occur strictly off-platform via direct user settlement channels. The platform will not mediate, track, or assume responsibility for payment defaults or ledger errors occurring between users. If an Academy refuses or fails to pay a professional Coach their contracted fee, or if a Coach breaches a professional commitment to an Academy, the Platform explicitly disclaims all liability, and the parties agree to resolve the dispute in independent civilian courts without naming the Platform as a party.
Users are strictly barred from deploying automated data scrapers, continuous code injections, or high-frequency query bots against our endpoints. Any user who breaches this restriction explicitly agrees to pay a mandatory, non-negotiable penalty of 500,000 INR per violation to compensate for security audit costs, without prejudice to our right to seek full criminal prosecution under Section 66 of the Information Technology Act.
THE PLATFORM ENVIRONMENT IS OPERATED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" STRUCTURAL BASIS. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. THE PLATFORM ASSUMES NO RESPONSIBILITY FOR PHYSICAL ACCIDENTS, HEALTH COMPLICATIONS, SCHEDULING DISRUPTIONS, ACCURACY ISSUES IN FINANCIAL LOGS, OR PERSONAL CONDUCT FAILURES OCCURRING DURING REAL-WORLD INTERACTIONS. UNDER NO CIRCUMSTANCES SHALL THE TOTAL LIABILITY OF THE PLATFORM EXCEED THE AMOUNT PAID DIRECTLY TO THE PLATFORM BY THE USER WITHIN THE PRECEDING 30-DAY OPERATIONAL WINDOW, OR 5,000 INR, WHICHEVER IS LESS.

The administrative ecosystems of PickProPals (including Gated Communities and Academies) are entirely governed, owned, and operated by autonomous third-party administrators (Community Admins, Academy Owners, and Portal Staff). The Platform functions as a technology provider and holds zero influence over administrative choices:
The Platform provides options for Users to self-declare their proficiency parameters within specific disciplines (e.g., Beginner, Intermediate, Advanced). The Platform does not audit, test, or verify the actual physical capabilities of any individual Node. If an Athlete misrepresents their experience level—resulting in unbalanced play, uncompetitive match sessions, wasted facility booking costs, or immediate event cancellations—the affected parties agree that the Platform holds zero liability for financial restitution, and all disputes regarding wasted court investments are completely barred from judicial claims against the Platform.
To establish identity validation, users may upload profile photographs, athletic credentials, logos, and related digital imagery datasets. By transmitting any media file into the Platform's distributed database nodes, you grant the Platform Owner an irrevocable, worldwide, non-exclusive, royalty-free, sub-licensable license to host, parse, cache, display, copy, transmit, and render your user-generated content solely to execute the portal's interface matching workflows. You warrant that you possess all legal copyrights over the uploaded media files and assume full liability if an asset violates a third party's trademark or visual privacy boundaries.
The Platform provides spatial data approximations and sorting layouts to help users locate nearby sports networks, open courts, and peer athletes. The user explicitly understands that transitioning from on-screen communication to an in-person, real-world physical meetup or competitive event is an autonomous choice executed at the user’s sole personal risk. The Platform disclaims all responsibility for personal safety. Under no circumstances shall the Platform or its platform owner be held civilly or criminally liable for physical altercations, criminal actions, sexual harassment, property theft, accidental injuries, or deaths occurring at physical sports grounds, training centers, or gated arenas discovered through the software directory.
The Platform reserves the right to implement premium subscription models, visibility boosters, or algorithmic sorting filters designed to optimize user routing preferences. Users acknowledge that purchasing a premium tier flag or visibility rank enhancement function constitutes a purchase of digital system prioritization only. The Platform issues zero warranties or performance guarantees that premium status will successfully result in secure bookings, increased coaching revenue, athletic approvals, or confirmed matching handshakes with other users. All monetization pipelines are non-refundable and subject to the default liability caps of this Agreement.
